1. Acceptance of Terms

By downloading, installing, or using the Sharoushi Quiz 2026 mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Twist Theory ("we," "us," or "our") regarding your use of the App.

2. Description of Service

Sharoushi Quiz 2026 is an educational mobile application designed to help users prepare for the Japanese Licensed Social Insurance Consultant (社会保険労務士) examination through:

• Practice questions based on past examinations
• Progress tracking and performance analytics
• Spaced repetition learning algorithms
• Study reminder notifications

3. User Accounts and Eligibility

The App does not require account registration. By using this App, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• Your use of the App complies with all applicable laws and regulations

4. Premium Subscription

4.1 Subscription Plans

The App offers both free and premium content. Premium features are available through:

• Monthly Subscription: Auto-renewing monthly plan
• Yearly Subscription: Auto-renewing annual plan at a discounted rate

4.2 Payment and Billing

• All payments are processed through Apple App Store (iOS) or Google Play Store (Android)
• Prices are displayed in your local currency and include applicable taxes
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your device's subscription settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Refund requests are subject to Apple's or Google's respective refund policies

5. Intellectual Property

5.1 App Content

All content in the App, including but not limited to:

• Practice questions and explanations
• User interface design and graphics
• Software code and algorithms
• Text, images, and other materials

are the exclusive property of Twist Theory or its licensors and are protected by intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes only.

5.3 Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any commercial purpose without written permission
• Share your subscription access with others
• Use automated systems to access the App

6. User Conduct

You agree not to:

• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's functionality
• Transmit any malicious code or harmful content
• Impersonate any person or entity

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of any content

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWIST THEORY SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or goodwill
• Any damages resulting from your use or inability to use the App
• Any damages exceeding the amount you paid for the App in the past 12 months

9. Indemnification

You agree to indemnify and hold harmless Twist Theory, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

10. Termination

We reserve the right to:

• Terminate or suspend your access to the App at any time without notice
• Modify or discontinue the App or any features without liability

Upon termination, your right to use the App immediately ceases.

11. Modifications to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date
• We may notify you through the App or via push notification
• Continued use of the App after changes constitutes acceptance

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes shall be resolved through:

1. Good faith negotiation between the parties
2. If unresolved, through the courts of Tokyo, Japan, which shall have exclusive jurisdiction

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Twist Theory regarding the use of the App.
